By accessing and using the Hammr Fitness mobile application ("the Service"), you accept and agree to be bound by these Terms of Service. This agreement is between you and Hamm Digital LLC. If you do not agree to these terms, you must not use the Service.
Hammr Fitness is a mobile application that provides AI-powered workout planning, nutrition tracking, and recovery insights. The Service is designed to assist with fitness and wellness goals.
HAMM DIGITAL LLC IS NOT A MEDICAL PROVIDER. The Service is for informational purposes only and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Always consult with a healthcare professional before beginning any exercise or nutrition program.
By using this Service, you acknowledge that exercise involves a risk of physical injury or death. You agree that you are voluntarily participating in these activities and assume all risk of injury to yourself. We do not guarantee specific results or outcomes.
Our Service utilizes Artificial Intelligence (AI) to generate workout plans, provide nutrition recommendations, and analyze user-uploaded photos for nutritional estimation.
AI-generated advice is experimental and should never replace professional coaching or medical advice.
The AI Food Logger provides estimates based on visual analysis. We cannot guarantee the accuracy of food identification, calorie counts, or macronutrient data. You are solely responsible for verifying the accuracy of any logged data before relying on it for dietary decisions.
AI models can occasionally generate incorrect, unsafe, or biased information ("hallucinations"). You are responsible for using your judgment before following any AI-generated instruction.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
The Service offers both auto-renewing subscriptions (billed monthly or annually) and one-time, non-renewing in-app purchases (such as consumable credit packs for AI photo analysis). Prices are subject to change with notice.
Subscriptions: Auto-renewing subscriptions will automatically renew unless canceled at least 24 hours before the end of the current billing period.
Consumable In-App Purchases: Purchases of consumable credits are one-time charges. Credits are tied to your account and do not expire as long as your account remains active, but they are strictly non-refundable and cannot be transferred or redeemed for cash.
All purchases and subscriptions are processed by Apple. We do not store your credit card information.
You must cancel your subscription through your Apple ID Settings. We cannot cancel subscriptions on your behalf.
All refund requests must be submitted directly to Apple via reportaproblem.apple.com. As a developer, we do not have the ability to process refunds directly.
You retain ownership of all content you upload to the Service (including workout logs, body stats, and food photos). By uploading content, you grant us a worldwide, royalty-free license to use, store, and process that content (including submitting it to third-party AI providers for analysis) solely for the purpose of providing and improving the Service.

The Service, including all content, features, and functionality (excluding User Content), is owned by Hamm Digital LLC and protected by copyright, trademark, and other intellectual property laws.
To the maximum extent permitted by law, Hamm Digital LLC shall not be liable for any indirect, incidental, special, or consequential damages (including strictly for physical injury or incorrect nutritional data) arising from your use of the Service. In no event shall Hamm Digital LLC's total liability to you for all damages, losses, and causes of action exceed the amount you have paid to Hamm Digital LLC for the Service in the last twelve (12) months, or fifty dollars ($50.00), whichever is greater.
These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law principles. Any legal action arising under these Terms will be instituted exclusively in the federal or state courts located in Sarasota County, Florida.
We reserve the right to modify these terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
